A BILL making a supplementary appropriation of public moneys out of the treasury from the state fund, general revenue, from surplus accrued for the fiscal year ending the thirtieth day of June, one thousand nine hundred ninety-three, to the division of corrections--correctional units, "Former" account no. 3770, "WVFIMS" account no. 0450, supplementing chapter one, acts of the Legislature, first extraordinary session, one thousand nine hundred ninety-three, known as the budget bill.

Be it enacted by the Legislature of West Virginia:
That chapter one, acts of the Legislature, first extraordinary session, one thousand nine hundred ninety-three, known as the budget bill, be supplemented and amended by adding to Title II, section eight thereof, as follows:
TITLE II--APPROPRIATIONS.
Sec. 8. Appropriation from surplus accrued.

Notwithstanding the provisions of Title I, section three, the secretary of the department of military affairs and public safety shall have the authority to transfer funds within the above surplus account: Provided, That no more than twenty-five percent of the surplus funds appropriated to any one line item may be transferred to other line items: Provided, however, That no funds from other line items shall be transferred to the personal services line item.
The purpose of this supplementary appropriation bill is to supplement the budget act for the fiscal year 1993-1994 by increasing line items 1, 4, 5 and 6 and providing for two new items of appropriation to be established therein to appropriate surplus accrued in the general revenue fund for the fiscal yearending June 30, 1993, and to be available for expenditure in the fiscal year 1993-94 contingent upon release of the surplus by the West Virginia supreme court of appeals.
